Website Terms and Conditions of Use

This website (the "Website") is a complimentary information service provided by the Recycled Paperboard Technical Association ("RPTA") at no charge to users of the Website, with the express condition that these users agree to be bound by the terms and conditions set forth in these Website Terms and Conditions of Use. RPTA reserves the right to change these terms and conditions at any time, without notice to you, and you must consult the most recent version of these Website Terms and Conditions of Use (not an older cached version) each time you view the Website. Use of the Website constitutes your acceptance of these terms and conditions, in their current form or as modified.

User License

Permission is granted to users accessing the Website to temporarily download one copy of the information and other content on the Website (collectively, the "Content") for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the Content;
• use the Content for any commercial purpose, or for any public display (commercial or non-commercial);
• remove any copyright or other proprietary notations from the Website or the Content; or
• transfer the Content to another person or "mirror" the Content on any other server.

If you have reason to believe that your account is no longer secure, you must promptly change the affected User ID by using the appropriate update mechanism on the Website, if available, or by contacting the RPTA. The RPTA is not liable for any harm caused by or related to the theft, misappropriation, disclosure, or unauthorized use of your User ID. The RPTA may terminate your registration and/or account, or otherwise prevent or limit your access to the Website, at any time, in its sole discretion.

User Obligations

You warrant that you will abide by all applicable local, state, national and international laws and regulations with respect to your use of the Website and not interfere with the use and enjoyment of the Website by others or with the operation and management of the Website. You warrant that you will not impersonate any other person or entity, whether actual or fictitious, when using the Website, or defame or otherwise harm any party, including but not limited to the RPTA, through your use of the Website.

Without limiting the foregoing, the RPTA does not make any representation or warranty regarding the accuracy, completeness, currency or reliability of the Content or on any other websites to which the Website is linked.

LIMITATION OF LIABILITY; NO CONSEQUENTIAL DAMAGES

You agree that you release and will hold harmless the RPTA and its officers, directors, employees, and volunteers from all claims arising out of or related to your access or use of, or your inability to access or use, the Website or the Content or other websites to which it is linked. In no event will the RPTA or its officers, directors, employees and volunteer, or any other contributors of Content or service providers, be liable to you or anyone else for any decision made or action taken by you in reliance on the Website or the Content, or for any consequential, indirect special or similar damages, even if advised of the possibility of such damages.

Indemnification

You agree to indemnify the RPTA and its affiliates, employees, agents, representatives and third-party service providers, and to defend and hold each of them harmless, from any and all claims and liabilities (including attorneys' fees) which may arise from your submissions, from your unauthorized use of material obtained through the Website, or from your breach of this Agreement, or from any acts taken through your use of the Website.

Governing Law and Jurisdiction

Any claim arising out of or relating to the Website or the Content shall be governed by the laws of the State of Illinois without regard to its conflict of law provisions. You and the RPTA also agree and hereby submit to the exclusive personal jurisdiction and venue of the state and federal courts located in Chicago, Illinois with respect to any such claims.

Usage Outside of the U.S.

The RPTA controls and operates this Website from the United States. The Website is not intended to subject the RPTA to the laws or jurisdiction of any state, country or territory other than that of the United States. The RPTA does not represent or warrant that the Website is appropriate for use in any particular jurisdiction. Those who choose to access the Website do so at their own initiative and are responsible for complying with all local laws, rules and regulations.

Linking Information

The RPTA permits text links to content on the Website provided that: (a) any text-only link must clearly be marked "Recycled Paperboard Technical Association"; (b) the appearance, position and other aspects of either the link or the host website may not be such as to damage or dilute the goodwill associated with the RPTA name and trademarks; (c) the appearance, position and other aspects of either the link or the host website may not create the false appearance that an entity other than the RPTA is associated with or sponsored by the RPTA; (d) the link, when activated by a user, must display the Website full-screen and not with a "frame" on the linked website; and (e) the RPTA reserves the right to revoke its consent to the link at any time in its sole discretion, either by notice to the linking website or by amending these Website Terms and Conditions of Use.
